Definitions "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;
"Consumer" shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
"Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
"Goods" means the articles that the Buyer agrees to buy from the Seller;
"Seller" means Betsy Jarvis and operates www.betsyjarvis.co.uk
"Terms and Conditions" means the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller.
Conditions
Nothing in these Terms and Conditions shall affect the Buyer's statutory rights as a Consumer. These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer. Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer's acceptance of these Terms and Conditions. Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller. Any complaints should be addressed to the Seller.
Description of Goods
We take every care to ensure that the description and specification of our products are correct at the time of going to press. However, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you. We aim to hold stock of all styles and colours etc., whilst a product is active. However, occasionally an item will be out of stock and if this is the case this will be highlighted.
Shipping & Delivery
Orders are usually despatched within 5 working days, to arrive with UK customers within 7-10 working days. In the event that an item is delayed, we will notify you of the delay and despatch it as soon as it is possible.A delivery charge will be added to your order value where appropriate, as follows: Our postage and packing rates are based on the value of the total order.

All Betsy Jarvis product prices are inclusive of Postage and Packing for mainland UK.
Postage for non UK Mainland
**Please note that due to customs restrictions we are unable to post the feather cushion fillers or Lavender products outside of Europe. Thank you**
For Europe we charge £4.00 Postage and Packing for the first item and a further £2.00 for each additional item.
For the USA, Canada, Australia and the rest of the world we charge £5.00 Postage and Packing for the first item and a further £2.50 for each additional item.

Betsy Jarvis is committed to protecting your privacy and maintaining the security of any personal information received from you. We strictly adhere to the requirements of the data protection legislation in the UK.
The purpose of this statement is to explain to you what personal information we collect and how we may use it. When you order, we need to know your name, address, email address, card details, delivery and shipping address. This allows us to process and fulfil your order. You have the option to withhold personal information that is not required for the order process. We use your personal information solely for payment and billing purposes. We will only contact you with your consent. We do not sell, rent or exchange your personal information with any third party for commercial reasons, beyond the essential requirement for credit/debit card validation during purchase. We follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access in accordance with the UK data protection legislation. We do not collect sensitive information about you except when you specifically knowingly provide it. In order to maintain the accuracy of our database, you can check, update or remove your personal details by logging into the website. We use a technology called "cookies" as part of a normal business procedure to track patterns of behaviour of visitors to our site. A cookie is an element of data that our Website sends to your browser which is then stored on your system. You can set your browser to prevent this happening. Any information collected in this way can be used to identify you unless you change your browser settings. In order to process credit/debit card transactions, the bank or card processing agency may require to verify your personal details for authorisation outside the EEA (European Economic Area). Your name and address details remain confidential with us and will not be exchanged or handed to any third party.
Returns & Replacements Returns
We check everything before we send it to you and do our very best to ensure that all our products are of the highest quality. However, if you are dissatisfied in any way we will exchange the products, provide a refund or a credit note.Please contact us so we can arrange their return.We would suggest you obtain a proof of posting certificate from the post office as we cannot be held responsible for goods lost or damaged in transit Postage costs will be refunded if goods are faulty. Should you receive damaged goods, then please notify us within 24 hours of receipt (your statutory rights will not be affected).
The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller by phone within 3 working days of delivery if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.
Where a claim of defect or damage is made the Goods shall be returned by the Buyer to the Seller. The Buyer shall be entitled to a full refund (including delivery costs) plus any return postal charges if the Goods are in fact defective.
If you are a consumer you have the right, in addition to your other rights, to cancel the Contract and receive a refund by informing the Seller within 3 working days of receipt of the Goods. Goods must be returned by the Buyer at the Buyer’s expense and should be adequately insured during the return journey. The Buyer will receive a refund of all monies paid for the Goods (including delivery charges, if any) Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the Price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever. Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees. No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.
Force Majeure The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.
Faulty GoodsWhere the fault is due to a manufacturing defect, will be exchanged or refunded where possible within the first 14 days of purchase. Damaged goods must be reported within 24 hours of delivery of the goods. After this time we cannot accept responsibility for damage reported.
Ordering All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 30 days.
We are thorough in ensuring that the information relating to each product is accurate at the time of publication. As many of our items are made by hand, unique and slight variations in colour, texture, size and pattern will occur.When you are ready to make a purchase, simply click "Add to Basket" to add the item to your shopping basket. You can then either return to the website to continue shopping or go on to our secure checkout, where you will see the total price including delivery. You can view the contents of your basket at any time by clicking 'View Basket' at the top right of each main page.
Cancellation Your Right To Cancel: you may cancel your order (once accepted by us) for any reason, up to the point of despatch. If you do cancel the contract within this time any payments made by you will be refunded in full within 30 days
Payment, Pricing & Promotions The price of the Goods shall be that stipulated on the website. The price is inclusive of VAT, where applicable. The price excludes delivery charges.
The total purchase price, including VAT and delivery charges, if any, will be displayed in the Buyer’s shopping cart prior to confirming the order.
After the order is received the Seller shall confirm by email the details, description and price for the Goods together with information on the right to cancel if the Buyer is a Consumer.
Payment of the price plus VAT and delivery charges must be made in full before dispatch of the GoodsThe Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure prices are correct at the point at which the Buyer places an order.
The Seller reserves the right to withdraw any goods from the Website at any time.
The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.For your peace of mind and for maximum security we use Paypal's secure payment service. You don't need a Paypal account and you can use your credit or debit card to pay for your order. Simply choose your preferred payment method on the checkout page.We accept Visa, Mastercard and Switch/Maestro. All prices quoted on this website are accurate at the time of publication and are quoted in pounds sterling (£) and where appropriate are inclusive of UK sales tax (VAT) at the current rate. If your order is being despatched to a destination outside the European Community (EC) then any customs or import duties levied once the package reaches your destination country will be your responsibility as we have no control over these charges and cannot predict them.
